These Terms and Conditions govern the sale of all orders placed by customer(s) (hereinafter referred to as “you” or the “customer”) on the domain sunchiswimwear.nl or any subdomains, from the moment you place an order through payment and delivery. By ordering a product, you agree to be legally bound by these Terms and Conditions.

Our webshop is hosted by Shopify Inc., which provides us with the online e-commerce platform that allows us to sell our products to you.

Sunchi Swimwear reserves the right to refuse or terminate the provision of services at any time and for any reason. You understand and agree that your content (excluding payment information) may be transferred unencrypted across various networks and may be adapted to meet the technical requirements of connecting networks or devices. Payment information is always encrypted during transmission. You may not reproduce, duplicate, copy, sell, resell, exploit, or commercially use any
portion of the services, content, or products of Sunchi Swimwear without prior written permission.
3. Intellectual Property
All intellectual property rights relating to the website, products, designs, logos, images, texts, campaigns, product names, and other content are exclusively owned by Sunchi Swimwear or its licensors. It is not permitted to use product photos or campaign images of Sunchi Swimwear for your own commercial purposes, including resale via other platforms, without prior written consent. Sunchi Swimwear reserves the right to modify these Terms and Conditions at any time. The new version will not apply retroactively, and the parties are bound only by the Terms and Conditions published online on the day the order is placed.
5. Changes to Products, Services, and Prices
Sunchi Swimwear reserves the right to refuse or cancel the execution of any order placed on the website. We expressly reserve the right not to accept your order for any of the following reasons:
- The product is not available (“out of stock”).
- Your billing information is incorrect or unverifiable.
- Your order is suspected of fraudulent activity.
- Our couriers were unable to deliver to the shipping address provided at checkout.
- Force majeure.
- In the event of typographical errors, pricing errors, or other inaccuracies on the website.
6. Products or Services
Certain products are available exclusively online and may have limited stock. Returns are only possible in accordance with our return policy. Returns are accepted within 14 days, provided the item is unused and in its original condition (including tags and hygiene strips). A damaged or incorrect item must be reported within 24 hours.
We make every effort to display product colors and images as accurately as possible, but we cannot guarantee that your screen’s display of any color will be exact. Product descriptions and prices are subject to change at any time. Once your return package has reached our warehouse and has been inspected and approved, your refund will be processed. We aim to process returns within 14 working days. It may take up to an additional 10 working days for the refund to appear on your original payment method.
7. Customs, Taxes, and Import Duties (Orders Outside the EU)
For orders outside the EU, any applicable import duties, taxes, and surcharges are charged at checkout and forwarded by us to the customs authorities of the destination country. These costs will not be refunded by Sunchi Swimwear in the event of returns from outside the EU.
8. Right of Withdrawal and Care During Fitting
During the statutory 14-day cooling-off period, swimwear may only be tried on while wearing your own underwear, for hygiene reasons.
The right of withdrawal expires if the hygiene strip has been removed or damaged. Returns may also be refused if the product shows visible signs of wear, use, damage, alteration, or other traces of use. To qualify for a return, labels, price tags, and hygiene strips must remain fully intact and attached.
9. Delivery & Shipping Times
We strive to ship orders as quickly as possible. Exceeding a delivery time does not entitle you to compensation or cancellation, unless otherwise required by law. Product prices on the website include VAT. Shipping costs are calculated per order. The exact shipping rate applicable to your order depends on the delivery location.
10. Payment Methods
Various payment methods are available and will be displayed during checkout. Please note: we do not accept cash, cheques, or Afterpay. Sunchi Swimwear is not liable for malfunctions or delays caused by external payment providers.
11. Billing and Account Information
We reserve the right to refuse any order or to limit quantities per customer, household, or order. You agree to provide current, complete, and accurate information and to update it if necessary.
